CODE OF PRACTICE 24 In November 2011, ALC wrote to the CEOs of Australia's top 2000 companies to provide them with information on the NLSC and invite them to develop their own industry code under the NLSC, or to join one of the NLSC's constituent codes -- the RLSC and the Steel Code. The letter drew attention to the new national approach to Chain of Responsibility that will come into effect when the Heavy Vehicle National Law comes into force. In the letter, we advised Australia's top companies that becoming a part of the NLSC would help them to comply with their Chain of Responsibility requirements. The Code sets out their responsibilities when they control or influence The RLSC is a voluntary scheme led by industry, with more than 70 members, both large and small. The Code is designed to ensure that all participants are aware of their responsibilities in the supply chain when they control or influence the carriage of freight. The 10-point code supports a clear Chain of Responsibility in freight logistics, involving all parties in the operation, from the supplier and retailer to the carrier and logistics provider. On 2 September 2011, the code was registered as a Code of Practice by VicRoads under the state's Road Safety Act 1986. Signatories to the Code can use it as the basis of a 'reasonable steps' defence if changed with an offence in Victoria. ALC expects that Codes registered in Victoria -- including the RLSC -- will be granted automatic registration under the Heavy Vehicle National Law when it commences from 1 January 2013. National Logistics Safety Code of Practice (NLSC) the movement of freight. Chain of Responsibility means that all parties in the supply chain -- including management and directors -- can be held responsible for safety, if it can be demonstrated that they may have contributed to a safety breach; however, compliance with the Code would give a company a 'reasonable steps' defence, if charged with a breach. Like the RLSC, the NLSC was registered as a Code of Practice under the Victorian Road Safety Act 1986 on 26 October 2011. ALC expects that codes registered in Victoria will be granted automatic registration under the national law when it commences from 1 January 2013. Retail Logistics Supply Chain Code of Practice (RLSC) Registration of the RLSC as a Code of Practice by the National Heavy Vehicle Regulator would mean compliance with the Code could be taken as evidence that all reasonable steps were taken to prevent a contravention of the new law, and assist operators in complying with Chain of Responsibility requirements under the HVNL. In effect, it shifts the burden of proof from the defendant to the prosecution to show that reasonable steps were not taken to prevent a contravention. Having the Code recognised nationally would provide industry with a low-cost path to compliance. It would provide signatories with greater certainty in interstate carriages that they are meeting heavy vehicle and OHS requirements. In early 2012, Conor O'Malley, Coles General Manager Logistics, was appointed as Chair of the ALC Retail Logistics Supply Chain Code of Practice Management Committee.
