It also argues that a valid case for the introduction of ‘Safe Rates’ has not been made, and highlights our belief that the introduction of a new Tribunal would unreasonably limit industry efforts to increase productivity in the sector. Limiting the ability of management to manage their affairs in a way that is efficient, safe and strategically appropriate is not in the industry’s long-term best interests, particularly when it is faced with an ever- increasing freight task. This Policy was updated when the Road Safety Remuneration Bill was tabled in the House of Representatives. ALC raised major objections to the government’s legislation to establish a new road safety remuneration system for Australian trucking. The legislation would create an industry tribunal with powers to set pay and pay-related conditions. ALC put forward submissions and made public statements about the legislation throughout 2011. In February 2012, ALC Managing Director Michael Kilgariff appeared before the House of Representatives Standing Committee on Infrastructure and Communications inquiry into the legislation and reiterated ALC’s opposition. ALC has stated that another layer of bureaucracy is unnecessary and that the Bill is a heavy-handed regulatory approach that will not improve safety or productivity in the heavy vehicle industry. Driver safety is already dealt with by other bodies. Safety works best when industry takes the lead. ALC has also pioneered the National Logistics Safety Code of Practice and the Retail Logistics Supply Chain Code of Practice, which are industry-driven responses to improving safety along the supply chain. The whole need for ‘safe rates’ legislation and whether it would add anything to safety should be questioned. While ALC took a firm position in opposing the Road Safety Remuneration Bill, given its subsequent passing by the Parliament, ALC is committed to working with the Tribunal to ensure it fulfils the stated objective of increasing safety in the industry.
