ALC POLICY 20 In September 2011, ALC released its policy on National Transport Legislation, calling for the National Heavy Vehicle Regulator, the Rail Safety Regulator and the Marine Safety Regulator to be 'national' in both practice and name. The Policy, which ALC provided to Australia's transport ministers, reflected our concerns that the national transport regulators agreed to by COAG on 19 August 2011 would not have the authority or resourcing necessary to deliver on the anticipated benefits of this reform. The Policy clearly states ALC's expectations for the national regulators to have the 'teeth' required to ensure the national laws operate in a uniform fashion nationally, arguing that such an approach is critical to boosting productivity, increasing efficiency and improving safety in the freight transport and logistics industry. The Policy includes three 'keys to success' that ALC believes are critical to maximising the economic benefits of the national transport reforms. We believe the three new regulators must: • replace the 23 state-based regulators with current responsibility for administering transport laws • have full responsibility for policy and legislation development • receive adequate funding in the form of transferred funds from the state jurisdictions, with powers to use these funds to administer all elements of the national laws. In the policy, ALC also articulated its belief that full responsibility for heavy vehicle legislation development should be transferred from the National Transport Commission to the National Heavy Vehicle Regulator Project Office. In November 2011, ALC released a National Policy on Safe Rates to draw attention to a number of facts that were being overlooked in the debate. The policy articulates ALC's overriding commitment to safety as evidenced by the development of the ALC Safety Codes, and also questions whether another layer of regulation in the name of safety is needed in the heavy vehicle industry.
